Nursing negligence often grounds for medical malpractice lawsuits

Many Florida residents currently have family members living in nursing homes. While some nursing patients are able to function independently in certain capacities, others are completely dependent on staff members for care. This was the case for three different people who had been residing at the same nursing facility over the past two years, all of whom suffered fatal injuries related to suspected neglect involving ventilator systems.

In the most recent situation, which occurred last year, a 78-year-old woman was on ventilator support. However, her machine had been shut down for nearly 40 minutes. She did not survive. Two other similar incidents have taken place at the same facility. 

The department of health in that state determined that all three deaths were likely caused by neglect. One of the victims died after a ventilator tube became disconnected. No one came to check on the resident for nearly an hour, even though the machine's alarm sounded. The other patient died a day after a nurse had shut off the resident's ventilator two hours too soon.

Such situations are understandably tragic for family members of Florida victims, particularly when it appears a  loved one's death was preventable. Grieving families often have recourse through the civil justice system, and a lawyer familiar with nursing negligence cases help. Families in these circumstances are able to file medical malpractice claims against any and all parties deemed responsible based upon the available evidence. Plaintiffs in such cases are tasked with proving in court that negligence occurred and was directly responsible for the death in question.
