Did you come home from your shopping trip with a painful injury?

When you are in a Florida store, you are probably looking for the things on your grocery list or some new clothes. Perhaps you want to pick up a few things for a home improvement project. No matter what type of shopping you are doing or the type of store you are visiting, you probably don't expect you will suffer injuries or be in an accident.

Stores are generally safe, but accidents can happen in these types of places every day, and shopping carts are often to blame. If you suffered injuries while you were in a store because of an accident with a shopping cart, it may not be your fault. You could be a victim of circumstances beyond your control, and you may have grounds to move forward with a civil claim against the retail establishment.

The dangers of shopping carts

Injuries related to the use of a shopping cart may not seem like a big deal, but they can be quite painful and debilitating. You may be unsure if what happened to you was your fault, even partially, or if the store was negligent in some way. It is not always easy to determine whether you have a valid claim, but you may have a valid case if you can prove the following:

  • The store owed you a certain duty of care to have safe shopping carts available for customers.
  • The establishment breached that duty by failing to provide shoppers with safe premises, including safe-to-use shopping carts in the store.
  • Because the store breached a reasonable duty of care, you suffered injuries due to a dangerous shopping cart or accident involving a cart.
  • You have evidence that this incident led to real injuries that resulted in pain, suffering and medical expenses.

In addition to proving these elements, you will also need to provide documentation that proves your injuries and the extent of financial damage you experienced.

The right type of claim

Depending on the nature of your situation, you may have grounds for a civil claim against the store for negligence or because the store knew there were conditions that could harm customers

If you think you may have a valid case, it may help to seek an understanding of your legal options. Victims of shopping cart accidents have the right to seek fair compensation, recovery of their medical expenses and other types of damages.
